1. Acceptance of Terms

By downloading, installing, or using the Theory Test UK - 5 Languages application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and H&E Driven Limited ("we", "us", "our"), not with Apple Inc., Google LLC, or any app store provider.

2. Description of Service

The App is an educational tool designed to help candidates prepare for the UK driving theory test. It provides:

• Practice questions based on the official DVSA revision framework
• Hazard perception practice clips
• Mock exam simulations
• Content available in five languages: English, Bengali, Chinese (Traditional), Arabic, and Urdu

4. Content Accuracy and Updates

We make reasonable efforts to ensure that our content reflects the current Highway Code and DVSA revision framework. However:

• The Highway Code and DVSA guidelines may be updated by the UK Government at any time
• There may be a delay between official changes and updates to the App
• We do not warrant that all content is complete, accurate, or up-to-date at all times
• You should always refer to the latest official Highway Code and DVSA materials as your primary study source

We aim to release App updates promptly when official content changes. Free updates are included for users who have purchased the Pro upgrade.

5. In-App Purchases

5.1 Pro Upgrade

The App offers a one-time Pro upgrade (lifetime access) that unlocks the full question bank and all language translations. The price is as displayed in the Apple App Store or Google Play Store at the time of purchase, in your local currency.

5.2 Payment Processing

All purchases are processed by Apple (for iOS) or Google (for Android) through their respective app stores. We do not directly handle, store, or have access to any payment card details, billing addresses, or financial information.

5.3 Refunds

Refund requests are handled by the respective app store:

• Apple App Store: Request a refund at reportaproblem.apple.com
• Google Play Store: Request a refund through Google Play's refund process or contact us directly

5.4 Restore Purchases

If you reinstall the App or switch devices, you can restore your Pro upgrade at no additional cost using the "Restore Purchase" option on the upgrade screen.

6. Intellectual Property

All content within the App, including but not limited to:

• Questions, explanations, and educational text
• Translations in all supported languages
• Code-rendered traffic sign illustrations (proprietary designs; no government graphics are embedded)
• Hazard perception video content
• User interface design and layout
• App name, logo, and branding

is the intellectual property of H&E Driven Limited and is protected by copyright and other intellectual property laws. All rights are reserved.

7. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Copy, redistribute, or republish any content from the App
• Circumvent or attempt to bypass any access controls or purchase verification
• Use the App for any unlawful purpose
• Share your Pro upgrade access with others or use account-sharing tools
• Scrape, extract, or automate access to App content

8. Data and Privacy

The App collects no personal data. All learning progress is stored locally on your device and never transmitted externally. In-app purchase verification uses RevenueCat with anonymous device identifiers only.

You can delete all locally stored data at any time via the App's Settings menu or by uninstalling the App.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components
• The content will be complete, accurate, or current at all times
• The App will be compatible with all devices or operating system versions
• Use of the App will result in passing the DVSA theory test

10. Limitation of Liability

To the fullest extent permitted by law, H&E Driven Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Failure to pass the DVSA theory test
• Loss of data or learning progress
• Any costs associated with retaking the theory test
• Reliance on App content that may be outdated or inaccurate
• Device damage or data loss arising from App use

Our total liability for any claim arising from use of the App shall not exceed the amount you paid for the Pro upgrade.

11. Apple and Google App Store Terms

11.1 Apple App Store (iOS Users)

If you downloaded the App from the Apple App Store, you acknowledge that:

• These Terms are between you and H&E Driven Limited, not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• In the event of any failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them

11.2 Google Play Store (Android Users)

If you downloaded the App from Google Play, you acknowledge that Google LLC has no obligation or liability relating to the App or these Terms beyond what is specified in the Google Play Terms of Service.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, if you breach these Terms. Upon termination:

• Your right to use the App ceases immediately
• Locally stored data on your device remains under your control
• Sections 6, 9, 10, and 14 survive termination

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes:

• The "Last updated" date at the top of this page will be revised
• The updated Terms will be posted at this same URL
• Where feasible, we will notify users through an in-app notice

Your continued use of the App after updated Terms are posted constitutes acceptance of those changes.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and H&E Driven Limited regarding the use of the App and supersede all prior agreements and understandings.
